Contrary to our story on Friday that EasyGroup had called off its easy domain crusade, boss Stelios Haji-Iannou has been in touch to assure us that he will strike down another three “easy” offenders in the next few months at the High Court.

Last week, Stelios withdrew his case against Easyart.com just weeks before it was due to start, saying that other, more important court cases were keeping him occupied.

Mobile operator Orange is suing EasyGroup to stop it using the colour orange when it launches mobile phone services next month.

Ironically Stelios launched a raft of lawsuits when he started his chain of internet cafes. He sued various firms with the word “easy” in their names. They were accused of “passing off” or confusing customers into thinking they were dealing with part of the easyGroup. Companies accused included easyprotest, easyart, easirent and easyrentaped. This time Stelios will be in the dock.

Brand wars

Stelios Haji-Ioannou is threatening legal action against a Welsh business unless it ditches its name.

Dave Evans runs a company called Esus which trades under the name easymobile. Up and running since 2003, Evans employs some 50 people in Swansea and Port Talbot, reports Ananova.

Stelios finally began accepting punters for his no-frills cellco easyMobile.com in March this year. But as someone highly protective of his brand, he’s given Evans just ten days to change the name of his business - or face legal action.

Stelios loses Swiss hotel name challenge

Thursday, May 25th, 2006

OUT-LAW News, 12/12/2005

EasyGroup has lost an attempt to eject the resident of easyhotel.ch, the director of a Swiss technology firm who was using the domain name to promote his firm’s services to Swiss hotels. EasyGroup was accused of trying to monopolise the word ‘easy’.

EasyGroup IP Licensing Ltd, the brand police for Stelios Haji-Ioannou’s easyGroup empire, argued that the name infringes its easyHotel trade marks. It took action before the World Intellectual Property Organisation (WIPO), arguing that Pascal de Vries of Basel-based Dexion AG should be stripped of the domain name. It cited trade mark and unfair competition laws to support its claim.

De Vries registered easyhotel.ch in June 2005. His company applied for the Swiss trade mark EASYHOTEL the same month in classes relevant to telecoms and IT services. There are 45 trade mark classes in total, and easyGroup said it had applied for the same mark in the class relevant to hotel accommodation.

So EasyGroup and their attention hungry CEO Stelios are branching into a new venture, EasyCinema in the cultural icon of the UK, Milton Keynes. Pricing according to demand is nothing new to EasyGroup, EasyJet have been doing it for years and if it brings savings who am I to argue? What I do object to are the puff press pieces complaining about how EasyCinema are being unfairly targeted by the UK film distributors. Stelios wants to play on a level playing field with Warner Brothers and the other UK cinema chains. The distributors won’t give him the newest releases, so he cries foul. Fair? Well yes, but there’s a problem.

Easy does it, phone firm tells easyJet boss

Cybersquatting, real or otherwise, has entered a new era where so-called offenders have started huddling together to collectively beat off predatory big companies. You can’t blame them either considering the way WIPO has decided to resolve domain name challenges.

Interestingly, the company we are referring to has already lost two WIPO challenges - namely, EasyGroup - owners of EasyJet, EasyRentacar and EasyEverything. It wasn’t surprising that EasyGroup lost the cases against easymaterials.com and easy-jet.com because it didn’t bloody deserve them. Neither were taken “in bad faith” nor do they try to capitalise on the EasyGroup brand (although orange featured quite heavily) and “easy” is a pretty common word and a good one to use in connection with a business.

Updated One group’s attempt to protect itself against corporate Internet bullying has failed with the loss of the EasyProtest.com Web site.

The protest site was set up in November and offered to give advice to anyone who owned a domain name starting with “easy”. This was to prevent the Easy Group - run by billionaire Stelios Haji-Ioannou - from taking over any and all such sites, claiming that they infringed the company’s trademarks.
